Reduction of administrative burdens

 

The government has adopted the Programme of Measures for Reduction of Administrative Burdens, which contains over thirty concrete measures aimed at simplifying procedures and raising the quality of administrative services. The Ministry of Public Administration will monitor the implementation of the programme and amend it with new measures. We have invited interested stake-holders to cooperate in decision-making regarding the elimination of administrative obstacles, to which end we have opened an e-mail address oao.predlogi@gov.si. Anyone can send their suggestions on improving individual procedures or regulations to the above address. The best proposals will be included in the government's programme.

 

We prevent new administrative obstacles by demanding that every proposing body (government, ministries) demonstrate the administrative burdens accompanying a regulation. They must either prove their inevitability or eliminate them and substantiate how to ensure quality of an administrative service (one-stop-shop, modern ways of payment, e-service, etc.). In compliance with the Rules of Procedure of the Government and adopted Methodology for fulfilling and monitoring the Declaration on the elimination of administrative barriers and cooperation of the interested public, a proposer must submit regulations to the Ministry of Public Administration at the level of the Ministry (rules, decisions, instructions) for an opinion prior to publication in the Official Gazette. 

Measuring administrative costs

Single administrative costs measurement methodology (EMMAS, final version 2.1, 31 July 2007) has been adopted as a part of better regulation, with the intention of administrative costs and burdens assessment. These are caused by the regulation (on the EU level as well as national and local) to businesses, citizens and public sector. According to the Lisbon Strategy better regulation and procedure simplification is of an exceptional importance since with reduction and elimination of administrative burdens savings for economy, citizens and public sector are created, which is very important for economic growth, investments, rise in living standard, new jobs and friendlier and more effective public administration, centred towards the user and its satisfaction.

 

On the basis of EMMAS, savings deriving from administrative burdens for entrepreneurs were assessed:

·          regarding simplification of registration, change and deletion of companies (limited liability companies) owing to e-VEM information system establishment, in the amount of 10,66 million EUR per year, or 75% comparing to the situation before e-VEM establishment;

·          regarding changes of Data Protection Act, in the amount of 36 million EUR;

·          regarding public procurement procedure changes the average cost of single public contract awarding has been reduced form 59 EUR to 5,40 EUR:

·          regarding legislation change and procedure simplification on employment and work of aliens, estimated savings amounted to 2,1 million EUR per year, or nearly 5 times shorter procedures for obtaining various permissions;

·          regarding establishment of court register as a public book savings amounted to 1,89 million EUR per year;

·          regarding the upgrade of Central Population Register with data on households (e-CRP) savings amounted to 1,1 million EUR per year.

 

Purpose of the methodology 

Methodology was developed with the intention of simplifying procedure on administrative costs assessment caused to businesses by the state (or local) regulation. The methodology was adopted by European Commission as a model for assessing administrative costs caused to businesses by the EU (European directives and other regulation).

 

Short procedure description

Using the administrative costs measurement model legislation is analysed so that certain data and information are defined (IO - information obligation - any additional obligation of the customers, which means an additional procedure, more demanding exercising of rights, more documentation submission etc., which in consequence means more time and higher costs). Data and information are further divided into activities which must be performed by the company (an individual or organization) to ensure necessary information set by the legislation. Thus administrative activities which can be measured are defined.
